I: General terms and conditions of business/delivery and mandatory information

As of: 02/2023

§ 1 – Scope

(1) These terms and conditions of Scheller Cosmetics GmbH (hereinafter: “Seller”) apply to all sales by the seller that the customer purchases from the seller via the seller’s online shop. Different conditions apply to resellers. The inclusion of the customer's conditions is contradicted unless the parties have expressly agreed otherwise.

(2) “Customers” are both consumers and entrepreneurs, whereby a consumer is any natural person who concludes a legal transaction for purposes that cannot predominantly be attributed to either their commercial or independent professional activity. An entrepreneur, on the other hand, is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

§ 2 – Conclusion of contract

(1) With the exception of orders via the “Direct to PayPal” button, the seller’s product offers merely represent an invitation to the customer to make a purchase offer. By completing the ordering process, the customer makes a binding purchase offer to the seller. Acceptance of this purchase offer by the seller will only take place through a separate declaration of acceptance or request for payment within 48 hours of receipt of the purchase offer.

(2) In the case of an order using the “Direct to PayPal” button, the seller’s product offers represent binding purchase offers to the customer. The acceptance of these purchase offers by the customer, and thus the conclusion of the contract between the parties, takes place by completing the ordering process.

(3) The ordering process by the customer begins by placing a product in the shopping cart using the “Add to cart” button or using the “Direct to PayPal” button on the product detail page. The customer can access his personal shopping cart at any time using the “Show shopping cart” button in the top menu bar. In the shopping cart, the customer has the option of changing the order quantity by entering the desired quantity and confirming using the “Update shopping cart” button or deleting a product from the shopping cart by pressing the “X” symbol button in front of the respective product .

a) Orders via the “PROCEED TO CHECKOUT” button:

Once the customer has filled his personal shopping cart with the products he wants, he can continue the ordering process using the “Continue to checkout” button on the following page.

If the customer has already registered for the seller's online shop, he can continue his order by entering his registered email address and the associated password in the "Do you already have a customer account?" field.

If the customer is not yet registered, he can either create a customer account with the seller by activating the “OPEN A CUSTOMER ACCOUNT?” field or continue his order as a guest. In both cases, the customer must subsequently provide their personal data.

Furthermore, the customer can select a payment method offered by the seller. The selection is made by activation with a “click”.

b) Order via “Direct to PayPal”

Optionally, the seller offers the ordering process via “Direct to PayPal”. In order to use this ordering option, the customer must be registered with “PayPal” or deposit the invoice details directly with “PayPal”. If the customer chooses this order option, after entering his email address registered with “PayPal” and the associated password, he will be redirected to his member account and can select the corresponding billing address stored with “PayPal”. If the order is placed without a PayPal member account, the customer's entries are confirmed using the “Agree and continue” button. After completing the information, the customer will be redirected to the seller's online shop.

Any corrections to the entered data that the customer wants to make can be made directly in the input fields using the conventional browser functions. The customer can edit the shopping cart using the browser function “go back” or “arrow to the left”.

In order to be able to carry out his order, the customer must further confirm the validity of the general terms and conditions by activating the field “I have read the general terms and conditions and agree to them. I have taken note of the right of withdrawal.” confirm.

His binding order for the products placed in the shopping cart the customer gives via the button “Buy now" away.

(4) Purchase processing and contact are made via email using the automated purchase processing software. The customer must therefore ensure that the email address he provided to complete the purchase is correct so that correspondence can take place. When using spam filters, the customer must ensure that all emails sent by the seller or its purchase processing service providers to process the purchase are received.

§ 3 – Contract storage

In the order confirmation sent by email, the customer's order details as well as the general terms and conditions customer information and the cancellation policy along with a sample cancellation form are sent. The contract text will not be saved by the seller after the contract has been concluded. The customer must therefore initiate further, permanent backups of the offer themselves (e.g. via screenshot).

§ 4 – Prices

The prices stated by the seller include all price components including the respective statutory German VAT. VAT is shown separately. The packaging and shipping costs are shown separately via the “Shipping” link and are charged additionally.
